Right of withdrawal

  • A Customer who is a consumer has the right to withdraw from a distance contract within 30 days of receiving the goods, without giving a reason.
  • This period is longer than the statutory minimum of 14 days under the Polish Consumer Rights Act of 30 May 2014 — the Seller has voluntarily extended it.
  • To meet the deadline it is enough to send the withdrawal statement before it expires.
  • Legal basis: Art. 27 of the Consumer Rights Act of 30 May 2014.

How to request a return

  • Returns are requested via the store website.
  • After the request, the Customer receives return instructions and a return label by email — this message also confirms that the Seller has received the withdrawal statement (Art. 30(4) of the Consumer Rights Act).
  • If the Customer chooses to notify withdrawal in a way other than via the website, please email support@wowbag.eu with:
    • a withdrawal statement (indicating the order/goods concerned)
    • the date the contract was concluded or the goods received
    • the Customer's full name
    • the Customer's address
    • the date of the request
  • In that case the goods must be sent back to: 05-552 Łazy, Rozmaitości 2, Rampa B.

Sending the goods back

  • The goods must be sent back without delay, no later than 14 days from the day the withdrawal statement was submitted. To meet the deadline it is enough to send the goods before it expires.
  • The Customer bears the cost of returning the goods:
    • Return via parcel locker or drop-off point — 10 zł gross
    • Return via courier (bulky items — courier only) — 15 zł gross
  • The return cost is deducted from the amount refunded to the Customer — the Customer does not pay it separately.
  • Legal basis: Art. 34(1) (return deadline) and Art. 34(2) (return costs borne by the Customer) of the Consumer Rights Act of 30 May 2014.

Refund of payment

  • Under Art. 32(1) of the Consumer Rights Act of 30 May 2014, the Seller must refund all payments received from the Customer, including the full cost of the original delivery.
  • Under Art. 32(3) of the Act, the Seller exercises the right to withhold the refund until the goods are received back — the refund is therefore made within 7 days of receiving the returned goods.
  • The refunded amount is reduced by the return shipping cost (10 zł or 15 zł gross, depending on the chosen return method — see "Sending the goods back").
  • The refund is made using the same payment method the Customer used, unless the Customer has expressly agreed to another method that involves no additional cost to them.

Liability for diminished value of the goods

  • The Customer is liable for any diminished value of the returned goods resulting from use beyond what is necessary to establish their nature, characteristics and functioning (e.g. visible signs of wear or use, physical damage).
  • The Seller inspects the condition of returned goods, including original tags, labels and original packaging — their absence or damage may indicate that the goods were used beyond trying on or checking them.
  • In such a case the Seller may reduce the refund by the amount by which the value of the goods has actually decreased, assessed individually based on their condition.
  • Legal basis: Art. 34(4) of the Consumer Rights Act of 30 May 2014.

Uncollected original parcel and refunds

  • If the original parcel was not collected by the Customer and was returned to the Seller (per the Delivery policy), and the order is not re-shipped, the Seller contacts the Customer to agree next steps.
  • If such an order is refunded, the refund is reduced by the cost of the original, uncollected delivery — because the Seller actually incurred that cost, regardless of whether delivery was originally paid or free.

Final provisions

  • This document forms an integral part of the WOWBAG.EU store Terms and Conditions.
  • In matters not covered here, the Polish Civil Code and the Consumer Rights Act of 30 May 2014 apply.
